1. INTRODUCTION 

These General Terms and Conditions of Sale (hereinafter “Terms”) govern the offer and sale of products on the website marcodelucagioielli.com (hereinafter the “Site”). The products purchased on the Site are sold by Marco De Luca Jewels (hereinafter the “Seller”), based in Rome, Italy.
By placing an order, you confirm that you have read, understood, and accepted these Terms.

2. PRODUCTS AND CRAFTSMANSHIP

2.1 Handmade Nature Our jewelry is handcrafted using traditional artisanal techniques (lost-wax casting, hand-finishing, oxidation). Important: Slight variations in texture, finish, oxidation, or shape are not defects but are characteristic features of a handmade product. These irregularities guarantee that each piece is unique and distinct from industrial productions.

2.2 Availability We strive to ensure that product availability is accurate. However, as our items are often made to order or in small batches, errors may occasionally occur. If an ordered item is unavailable, we will notify you immediately and issue a full refund.

3. PRICING AND PAYMENT

3.1 Prices All prices are expressed in Euros (€) and include VAT (where applicable under Italian law). Shipping costs are calculated at checkout and are not included in the product price.

3.2 Payment Methods We accept payments via [Credit Card / PayPal / Stripe / Apple Pay]. Your order will be processed only after payment has been confirmed.

4. SHIPPING AND DELIVERY

4.1 Shipping Times

• Ready-to-ship items: Dispatched within 2-3 business days.
• Made-to-order items: Please allow [e.g., 10-15 business days] for production before shipping.

4.2 Customs & Duties For orders shipped outside the European Union, you are responsible for any customs duties, taxes, or import fees levied by your country. We have no control over these charges.

5. RIGHT OF WITHDRAWAL (RETURNS)

In accordance with EU Consumer Rights Directive, you have the right to withdraw from this contract within 14 days of receiving the goods without giving any reason.

5.1 How to Return

To exercise this right, you must notify us at marcodelucajewels@gmail.com within 14 days of delivery.

• You must return the goods to us without undue delay and in any event not later than 14 days from the day you communicated your withdrawal.
• Return Shipping Costs: You are responsible for the direct cost of returning the goods.
• Condition: The jewelry must be unworn, undamaged, and in its original packaging. We reserve the right to refuse returns that show signs of wear or damage.

5.2 Exceptions (Non-Returnable Items) The right of withdrawal DOES NOT apply to:
Customized or Personalized Jewelry: (e.g., rings with custom engravings, or bespoke sizes made specifically for you).

6. LEGAL GUARANTEE OF CONFORMITY

All products sold to consumers are covered by the 2-Year Legal Guarantee of Conformity provided by Italian law (Consumer Code).

• What it covers: Production defects or lack of conformity existing at the time of delivery.
• What it DOES NOT cover: Damage caused by accident, misuse, normal wear and tear (e.g., scratching, plating fading over time), or unauthorized repairs.

7. LIMITATION OF LIABILITY

Marco De Luca Jewels shall not be liable for any indirect or consequential damages arising from the use of the Site or products, except in cases of willful misconduct or gross negligence.

8. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of Italy.
Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the Court of Rome, Italy.
